Judge denies injunction request from Arlington Township

ARLINGTON TWP. – On Wednesday, June 12, a show cause hearing in Courtroom 3 at the Van Buren County Courthouse, before Judge Susan Metzger, saw Arlington Township ask the court to issue an injunction stopping Stoneco from engaging in gravel mining near the intersection of 42nd Avenue and County Road 215.
The court denied the request, finding that the Arlington Township decision to issue a Special Use Permit to Smith Trucking in 2011, and Arlington Township’s annual renewal of the permit, defeated the claim that Stoneco had to start from scratch in obtaining a new permit. The court found that, because of this, Arlington Township failed to establish a likelihood that it would prevail on the merits. The court found that Arlington Township was authorized to continue with its lawsuit. Stoneco was authorized to continue its current work starting on Saturday, June 15, 2024.
