CENTREVILLE — The case against a Vicksburg man accused of killing a 10-year-old on Banker Street with his vehicle is now heading to Circuit Court.
On Tuesday, Logan Thomas waived a preliminary hearing in St. Joseph County 3B District Court, which means the case against him is bound over to St. Joseph County 45th Circuit Court for further proceedings and a possible trial.
Tuesday’s preliminary examination hearing would have attempted to establish probable cause that a crime was committed and probable cause that Thomas did the crime, but would not have established whether he was guilty or innocent of the alleged crime.
Earlier this month, Prosecutor Deborah Davis filed an amended complaint in the case upgrading the original charges against Thomas to one count of operating while intoxicated causing death, one count of operating with a suspended license causing death, both felonies, and one count of driving without insurance, a misdemeanor. The felony counts normally carry up to 15 years in prison, but because Thomas is alleged to be a fourth habitual offender, the charges could carry up to life in prison.
The charges against Thomas stem from a Dec. 2 incident where he was traveling westbound on Banker Street in Sherman Township when he allegedly failed to see a group of children in the area, hitting and killing 10-year-old Anthony Miller.
In late December, Thomas pleaded no contest and spent a day in jail for a bond violation when he reportedly tested positive for meth following a Dec. 16 drug test, which came three days after he was released from jail after posting $100,000 bond. Judge Jeffrey Middleton said that despite those “bumps in the road” with the bond conditions, there have been no issues since his no-contest plea for the bond violation.
Bond conditions will continue for Thomas as the case is bound over to Circuit Court. No hearing dates have been set yet in Circuit Court for the case.
